释义	律师解答： (1)逃离部队持续时间达三个月以上或者累计时间达六个月以上的;(2)担负重要职责的人员逃离部队的;(3)策动三人以上或者胁迫他人逃离部队的;(4)在执行重要任务期间逃离部队的;(5)有其他情节严重行为的。对于情节不严重的逃离部队的行为，应当按违反军纪处理。【法律依据】：《中华人民共和国刑法》第四百三十五条违反兵役法规，逃离部队，情节严重的，处三年以下有期徒刑或者拘役。战时犯前款罪的，处三年以上七年以下有期徒刑。
