释义	法律分析：预期违约又称先期违约，是指在合同履行期限到来之前，一方虽无正当理由但明确表示其在履行期到来后将不履行合同，或者其行为表明在履行期到来后将不可能履行合同。法律上有以下规定：当事人一方明确表示或者以自己的行为表明不履行合同义务的，对方可以在履行期限届满之前要求其承担违约责任。法律依据：《中华人民共和国民法典》第一百八十六条因当事人一方的违约行为，损害对方人身权益、财产权益的，受损害方有权选择请求其承担违约责任或者侵权责任。
