一、刑事赔偿金规定是什么
刑事赔偿金规定是按照我们国家赔偿法当中所作出的规定。自2020年5月18日起作出的国家赔偿决定涉及侵犯公民人身自由权的赔偿金标准为每日346.75元。国家统计局2020年5月15日公布，2019年全国城镇非私营单位就业人员年平均工资数额为90501元；日平均工资为346.75元。《国家赔偿法》规定：“侵犯公民人身自由的，每日赔偿金按照国家上年度职工日平均工资计算。”最高人民法院要求，各级人民法院要按照《最高人民法院、最高人民检察院关于办理刑事赔偿案件适用法律若干问题的解释》第二十一条第二款的规定，自2020年5月18日起审理国家赔偿案件时按照上述标准执行。
二、国家赔偿的种类有哪些
根据《国家赔偿法》的规定，我国国家赔偿的种类有三种；一是行政赔偿；二是刑事赔偿；三是民事、行政诉讼中国家侵权损害赔偿。行政赔偿是指行政机关及其工作人员，法律、法规授权的组织、受行政机关委托的组织或个人行使行政职权时，侵犯公民、法人和其他组织合法权益造成的损害；由国家通过侵权的机关或法律、法规授权的组织向受害人所进行的赔偿。刑事赔偿亦称冤狱赔偿，是指行使侦查、检察、审判、监狱管理职权的机关及其工作人员在行使职权时，侵犯当事人身权、财产权造成损害的，由国家予以的赔偿。民事、行政诉讼中的国家侵权损害赔偿，是指人民法院在民事诉讼、行政诉讼过程中，违法采取对妨害诉讼的强制措施、保全措施或者对判决，裁定及其他生效法律文书执行错误，造成公民、法人和其他组织损害的，由国家所承担的赔偿责任。当代社会国家赔偿是非常重要的，一种具体赔偿的方式，其中就会涉及到有刑事赔偿的部分。比如说如果在侦查羁押阶段错误的采取了拘留的措施，导致人身自由受到限制的情况。此时就需要根据上一年度职工工资来确定赔偿金。
