被拘役能解除缓刑的情形有哪些 |
| 释义 |
拘役是短期剥夺犯罪人自由，就近实行劳动的刑罚方法。拘役由公安机关在就近的看守所或者其他监管场所执行，在执行期间，受刑人每月可以回家一天至两天，参加劳动的，可以酌量发给报酬。拘役的期限为1个月以上6个月以下，数罪并罚时不得超过1年。拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于两个月缓刑，不是刑罚的种类，只是刑罚执行的一种制度，他是指人民法院对被判处拘役(管制除外)、三年以下有期徒刑的犯罪分子，根据其犯罪情节和认罪、服罪、悔罪表现，认为原判刑罚可以暂缓执行，规定一定期限的考验期，在考验期内没有发生法定的撤销缓刑的情形、原判刑期不再执行的一种刑罚执行制度。综上所述，只要符合条件，就可以或应当宣告缓刑。
