释义	家庭暴力是我国法律明令禁止的违法行为。家庭暴力不仅直接侵害了受害者的身体健康和生命安全，也伤害了受害者的精神健康，给受害者带来巨大的心理创伤。但是该赔偿必须以离婚为前提，如果法院判决不予离婚的案件，也不会支持当事人提出的损害赔偿请求。同样，在婚姻存续期间，不起诉离婚，单纯要求对方赔偿，法院也不会受理。
