诋毁商业信誉构成损害商业信誉罪的，一般要判处二年以下有期徒刑或者拘役，并处或者单处罚金。损害商业信誉、商品声誉罪是指捏造并散布虚伪事实、损害他人商业信誉和商品声誉、给他人的权益造成重大损失的行为。本罪侵犯的客体是复杂客体，即社会主义市场经济秩序和被害人的商业信誉。
