释义	法律分析: 对于未成年人，初次犯罪、过失犯罪、被诱骗犯罪的犯罪未遂者，如果情节轻微，对社会危害不大，而且和受害人达成了民事赔偿协议且切实履行了，这个也是可以在检察院阶段做出不起诉的决定的，但是仍需要进行其他的惩罚，比如训诫，责令悔过，赔礼道歉等处罚手段。法律依据: 《中华人民共和国刑法》第二十三条已经着手实行犯罪，由于犯罪分子意志以外的原因而未得逞的，是犯罪未遂。对于未遂犯，可以比照既遂犯从轻或者减轻处罚。
