上班在路上摔伤算工伤吗 |

上下班途中自己摔跤受伤不算工伤。
上下班途中受伤的只有是受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的才属于工伤，其他情况受伤的不认定为工伤。
一、骑自行车回家摔倒算工伤吗
下班骑自行车回家摔伤不属于工伤。关于上下班途中工伤认定的情形，在《工伤保险条例》中有相关规定：在上下班途中，受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的，属于工伤。但骑车摔倒属于由本人主要责任导致的受伤，不符合以上规定的情形，故不能认定为工伤。
二、被火车撞伤是否属于工伤
被火车撞伤是否属于工伤，要看是否符合工伤条件，具体如下：
1、在工作时间和地点内，因工受伤；
2、工作时间前后在工作地点内，因为预备和收尾工作受伤；
3、在工作时间和工作地点内，因工受到暴力等意外伤害；
4、患职业病；
5、因工外出期间，因工作受伤或失踪；
6、在上下班途中，受到非本人主要责任的交通事故或城市轨道交通、客运轮渡、火车事故伤害。
三、早退下班路上出车祸算不算工伤
这种情况不属于工伤，并非上下班途中发生的非本人主要原因的交通事故。职工在下班途中，受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的，应当认定为工伤。不符合上述情况的，职工在下班途中受伤不属于工伤。
