挪用公款罪是可以判缓刑的，只要是按照刑法应当判处三年以下有期徒刑且在一审前已经将占用的公款退回的，可以判处缓刑。
《最高人民法院关于对贪污、受贿、挪用公款犯罪分子依法正确适用缓刑的若干规定》中规定：“挪用公款进行营利活动或者超过三个月未还构成犯罪，一审宣判前已将公款归还，依法判处三年有期徒刑以下刑罚，符合刑法规定的缓刑适用条件的，可以适用缓刑；在案发前已归还，情节轻微，不需要判处刑罚的，可以免予刑事处罚。”
一、不能适用缓刑的有哪些情况
据《最高人民法院关于对贪污、受贿、挪用公款犯罪分子依法正确适用缓刑的若干规定》(1996年6月26日)规定，对下列挪用公款犯罪分子可不适用缓刑：
(1)犯罪行为使国家、集体和人民利益遭受重大损失的；
(2)没有退赃，无悔改表现的；
(3)犯罪动机、手段等情节恶劣，或将赃款用于走私、赌博等非法活动的；
(4)属于共同犯罪中情节严重的主犯，或有数罪的；
(5)曾因经济违法犯罪行为受过行政处分或刑事处罚的；
(6)犯罪涉及的财物属于特定款物，情节严重的。
