据实结算就是按照实际工程量进行结算，应该按照原投标报价和变更签证进行处理，不能全部推倒原来的预算重新进行计算的。

《最高人民法院关于审理建设工程施工合同纠纷案件适用法律问题的解释》 第二条 建设工程施工合同无效，但建设工程经竣工验收合格，承包人请求参照合同约定支付工程价款的，应予支持。
