释义	法律分析：传染病防治失职罪的立案标准为，涉嫌下列情形之一的，应予立案： 1、导致甲类传染病传播的； 2、导致乙类、丙类传染病流行的； 3、因传染病传播或者流行，造成人员死亡或者残疾的； 4、因传染病传播或者流行，严重影响正常的生产、生活秩序的； 5、其他情节严重的情形。构成此罪的会被处三年以下有期徒刑或者拘役。法律依据：《中华人民共和国刑法》第四百零九条从事传染病防治的政府卫生行政部门的工作人员严重不负责任，导致传染病传播或者流行，情节严重的，处三年以下有期徒刑或者拘役。
