外地人怎么开无犯罪记录证明 |
| 释义 |
人在外地仍可以在户籍地派出所开具无犯罪记录证明，但是不可以在外地的派出所开具无犯罪记录证明。
外地需要开证明的，需要委托他人进行办理，委托代理人持申请人的身份证或户口本到申请人户籍所在地的公安机关进行申请，该公安机关根据掌握的情况为申请人出具是否受过刑事处分的证明。
委托他人代办的，还需要提供代办人的身份证据及委托公证书或委托书。委托非直系亲属代办的需提供委托公证书，委托直系亲属代办的需提供委托书，需出示亲属关系材料，如户口本、结婚证、出生证等。
公安机关出具公民个人有无违法犯罪记录证明的情形：
1、因从事某种特定职业或行业以无相关违法犯罪记录为前提条件，公民本人提出申请的；
2、因出国（境）、诉讼需要，公民本人提出申请的；
3、因办理公民有无违法犯罪记录公证事项需要，公证机构提出申请的；
4、因服兵役、入党、招警（含警察院校招生）、招录公务员、从事航空招飞特殊职业等政审考察需要，相关单位提出申请的；
5、其他根据法律、法规、规章和有关文件规定，需要出具证明的情形。

第八条
符合下列情形之一，公安派出所可以出具违法犯罪记录证明：
(一)国家机关录用公务员政审
(二)中国共产党组织吸收新党员政审
(三)公证机构依法办理公民有无违法犯罪记录公证事项
(四)公民从事法律、法规、规章规定必须以无相关违法犯罪记录为前提的职业
(五)省辖市以上公安机关认为确需出具违法犯罪记录证明的其他情形。
