释义	代为清偿的适用条件是： (1)依债的性质，可以由第三人代为清偿。如作为债的关系内容的债务具有专属性，则性质上不许代为清偿。一般认为，基于债务性质不得代为清偿的情况有：不作为债务;以债务人自身的特别技能、技术为内容的债务;因债权人与债务人之间的特别信任关系所生的债务等。 (2)债权人与债务人之间无不得由第三人代为清偿的约定。但该约定必须在代为清偿前为之，否则无效。 (3)债权人没有拒绝代为清偿的正当理由，债务热也无提出异议的正当理由。 (4)代为清偿的第三人必须有为债务人清偿的意思。
