释义	法律分析：免费搭车出现事故谁负责任，如果驾驶员在交通事故中没有重大过错或者故意的，同乘者因交通事故受伤或者财产损失的，驾驶员不承担赔偿责任，如果存在故意或者过错的，应当酌情赔偿受害者损失。法律依据：《中华人民共和国合同法》第三百零二条即承运人应当对运输过程中旅客的伤亡承担损害赔偿责任，但伤亡是旅客自身健康原因造成的或者承运人证明伤亡是旅客故意、重大过失造成的除外。前款规定适用于按照规定免票、持优待票或者经承运人许可搭乘的无票旅客。
