释义	法律分析：债务人失踪的，如果有保证人的，可以向保证人主张债权；没有保证人的可以起诉要求债务人还款，法院会进行公告送达，公告期满视为送达，债务人不出现的可以缺席判决，法院判决后债权人可以申请强制执行。如果债务人失踪满两年的，债权人可以申请宣告其失踪，然后向其财产代管人主张债权，财产代管人从失踪人的财产中支付。法律依据：《中华人民共和国民法典》第四十条自然人下落不明满二年的，利害关系人可以向人民法院申请宣告该自然人为失踪人。
