释义	法律分析：在网购的时候如果遇到了卖家不发货，超出了卖家规定的发货时间，就算违约。违背发货时间承诺，是指除特殊情形外，卖家在买家付款后未按约定时间发货的，需向买家支付该商品实际成交金额的百分之五作为违约金，最高不超过30元，最低不少于5元，特定类目商品最低不少于1元(除特殊情形外)。法律依据：《中华人民共和国民法典》第五百七十七条当事人一方不履行合同义务或者履行合同义务不符合约定的,应当承担继续履行、采取补救措施或者赔偿损失等违约责任。
