释义	属于公诉案件，有公安机关侦查，交由检察院审查并提起公诉，法院审判。达到轻伤级以上的对方已经构成故意伤害罪，因为不属于亲告罪，原则上受害人不能直接到法院起诉，一般情况下是由公安机关立案侦查，检察院审查起诉。如果检察院没有提起公诉，但是被害人有证据证明受到轻伤害的可以到法院起诉。【法律依据】《治安管理处罚法》第43条殴打他人的，或者故意伤害他人身体的，处五日以上十日以下拘留，并处二百元以上五百元以下罚款;情节较轻的，处五日以下拘留或者五百元以下罚款。
