第四条 退出现役的士官符合下列条件之一的，作转业安置：
(一)服现役满10年的;
(二)服现役期间荣获二等功以上奖励的;
(三)服现役期间因战、因公致残被评为二等、三等伤残等级的;
(四)服现役未满10年，国家建设需要调出军队的;
(五)符合退休条件，地方需要和本人自愿转业的。
第五条 退出现役的士官符合下列条件之一的，作退休安置：
(一)年满55岁的;
(二)服现役满30年的;
(三)服现役期间因战、因公致残，被评为特等、一等伤残等级的;
(四)服现役期间因病基本丧失工作能力，并经驻军医院诊断证明，军以上卫生部门鉴定确认的。
