法律分析：
1、涉外离婚登记的前提条件(1)双方当事人必须是自愿离婚且已对子女抚养、财产、债务等事项达成一致意见；(2)当事人中一方必须是本地常住户口居民且原结婚登记必须是在中国内地办理的；(3)双方当事人必须具有完全民事行为能力；双方当事人必须共同到当地婚姻登记或中心申请办理离婚登记并领取《离婚证》。
2、涉外离婚登记的应提交的材料：(1)本人的户口簿、身份证；(2)本人的结婚证；(3)双方当事人共同签署的离婚协议书。办理离婚登记的香港居民、澳门居民、台湾居民、华侨、外国人除应当出具第(2)项、第(3)项规定的证件、证明材料外，港澳台出具有效的通行证，身份证，属于华侨、外国人的还应当出具本人的有效护照或者其他有效国际旅行证件。离婚协议书应当载明双方当事人自愿离婚的意思表示以及对子女抚养、财产及债务处理等事项协商一致的意见。

第二十六条 协议离婚，当事人可以协议选择适用一方当事人经常居所地法律或者国籍国法律。当事人没有选择的，适用共同经常居所地法律；没有共同经常居所地的，适用共同国籍国法律；没有共同国籍的，适用办理离婚手续机构所在地法律。
第二十七条 诉讼离婚，适用法院地法律。
第二十八条 收养的条件和手续，适用收养人和被收养人经常居所地法律。收养的效力，适用收养时收养人经常居所地法律。收养关系的解除，适用收养时被收养人经常居所地法律或者法院地法律。
