洗钱罪法定行为方式只能由作为方式构成，共5种行为方式：
1、提供资金账户：包括行为人将自己的合法账户提供给洗钱罪的上游犯罪的犯罪人使用，以及为洗钱罪的上游犯罪的犯罪人在金融机构开立假账户。因此，公众应当谨慎将自己帐号提供给他人使用，以免产生不必要麻烦。
2、协助将财产转换为现金、金融票据、有价证券。
3、通过转账或者其他结算方式协助资金转移。
4、协助将资金汇往境外。
5、以其他方法掩饰、隐瞒犯罪所得及其收益的来源和性质。
一、洗钱罪的上游犯罪有哪些
洗钱罪的上游犯罪是指产生洗钱罪的犯罪所得(指上游犯罪行为所直接产生的非法财产性利益：包括违法、犯罪所得资金、违法、犯罪所得财物)及其收益的各种犯罪行为。
洗钱罪的上游犯罪包括以下7种罪：
(1)毒品犯罪；
(2)黑社会性质的组织犯罪；
(3)恐怖活动犯罪；
(4)走私犯罪；
(5)贪污贿赂犯罪；
(6)破坏金融管理秩序犯罪；
(7)金融诈骗犯罪。
洗钱罪应当以上游犯罪事实成立为认定前提。洗钱罪的上游犯罪尚未依法裁判，但查证属实的，不影响洗钱罪的审判。洗钱罪的上游犯罪事实可以确认，因行为人死亡等原因依法不予追究刑事责任的，或者依法以其他罪名定罪处罚的，不影响洗钱罪的认定。
