释义	法律分析: 无罪释放的流程：依法讯问时发现其不构成犯罪，均须立即释放，并发给释放证明，对于被依法释放的人，看守所根据人民法院、人民检察院、公安机关或者国家安全机关的释放通知文书，办理释放手续。被拘留的人，依法讯问时发现其不构成犯罪，必须立即释放，并发给释放证明。法律依据: 《中华人民共和国刑事诉讼法》第一百六十三条在侦查过程中，发现不应对犯罪嫌疑人追究刑事责任的，应当撤销案件；犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。
