2023年法院判离婚为什么要先调解 |

法律分析：
1、通过离婚调解，使双方当事人思想沟通，达到缓解、消除矛盾、相互谅解的目的，促使婚姻关系向和美方向发展;
2、通过离婚调解，进行法治、道德宣传，促使双方当事人明确自己的权利和义务，自觉承担家庭责任，降低离婚率，确保社会稳定;
3、通过离婚调解，双方当事人能在法律和道德规范的要求下重新认识自我，在自律的基础上重新建立新的婚姻基础，巩固婚姻感情，有利于建立稳定的婚姻家庭关系;
4、经调离婚解双方当事人不能在统一认识的基础上达成协议，人民法院才判决离婚，在提高人民法院的判案质量的同时给当事人一个感情缓冲区，有充分的考虑余地。
法律依据：
《中华人民共和国民法典》 第一千零七十九条 夫妻一方要求离婚的，可以由有关组织进行调解或者直接向人民法院提起诉讼。人民法院审理离婚案件，应当进行调解；如果感情确已破裂，调解无效的，应当准予离婚。有下列情形之一，调解无效的，应当准予离婚：
（一）重婚或者与他人同居；
（二）实施家庭暴力或者虐待、遗弃家庭成员；
（三）有赌博、吸毒等恶习累教不改；
（四）因感情不和分居满两年；
（五）其他导致夫妻感情破裂的情形。
一方被宣告失踪，另一方提起离婚诉讼的，应当准予离婚。经人民法院判决不准离婚后，双方又分居满一年，一方再次提起离婚诉讼的，应当准予离婚。
