释义	我国刑法对组织黑社会性质组织罪的立案规定为：行为人有组织黑社会性质组织的行为的，就应当立案追诉。本罪为行为犯，只要组织了黑社会性质的组织的，并不要求再实施其他犯罪行为和造成犯罪结果，原则上就构成犯罪。【本文关联的相关法律依据】《刑法》第二百九十四条组织、领导黑社会性质的组织的，处七年以上有期徒刑，并处没收财产；积极参加的，处三年以上七年以下有期徒刑，可以并处罚金或者没收财产；其他参加的，处三年以下有期徒刑、拘役、管制或者剥夺政治权利，可以并处罚金。
