释义	法律分析：被保证人破产时，如果保证人已经代为履行债务的，保证人即取得代位求偿权，可以其承担保证责任并已清偿的范围内的债权申报破产债权，参加破产财产的分配。这种代位求偿权是基于保证人代被保证人清偿债务后取得新债权人的资格而产生的追偿权，无所谓一般保证或连带责任保证之分，保证人一经代偿，即有追偿权。法律依据：《中华人民共和国民法典》第七百条保证人承担保证责任后，除当事人另有约定外，有权在其承担保证责任的范围内向债务人追偿，享有债权人对债务人的权利，但是不得损害债权人的利益。
