释义	违法。捡到钱包不归还，可能涉嫌侵占罪。侵占罪，是指以非法占有为目的，将他人的交给自己保管的财物、遗忘物或者埋藏物非法占为己有，数额较大，拒不交还的行为。本罪的主体为一般主体，凡年满16周岁具有刑事责任能力的自然人均可构成本罪。本罪在主观方面必须出于故意，即明知属于他人交与自己保管的财物、遗忘物或者埋藏物而仍非法占为己有。犯罪对象只限于三种财物：一是代为保管的他人财物;二是他人的遗忘物，遗忘物不等于遗失物，也不同于遗弃物;三是他人的埋藏物。法律依据《中华人民共和国刑法》第二百七十条
