刑事拘留能判刑吗 |

法律分析：刑事拘留后，不一定会判刑。刑事拘留是一种刑事侦查强制措施，在侦查过程中或者侦查结束后都可以对犯罪嫌疑人采取。拘留犯罪嫌疑人之后，如果侦查机关认为犯罪嫌疑人不构成犯罪或者不予追究刑事责任的，可以决定撤销案件。移送公诉机关审查起诉后，公诉机关认为不构成犯罪或者不予追究刑事责任的，可以做出不起诉的决定。起诉到人民法院的，经过审判，法庭认为不构成犯罪或者不予追究刑事责任的，可以宣告无罪或者免予追究刑事责任。在侦查过程中，发现不应对犯罪嫌疑人追究刑事责的，应当撤销案件。犯罪嫌疑人已被逮捕的，应当立即释放，发给释放证明，并且通知原批准逮捕的人民检察院。所以，刑事拘留之后，到底会不会判刑，要结合具体的案情来确定。
法律依据：《中华人民共和国刑事诉讼法》 第十五条 有下列情形之一的，不追究刑事责任，已经追究的，应当撤销案件，或者不起诉，或者终止审理，或者宣告无罪：(一)情节显著轻微、危害不大，不认为是犯罪的;(二)犯罪已过追诉时效期限的;(三)经特赦令免除刑罚的;(四)依照刑法告诉才处理的犯罪，没有告诉或者撤回告诉的;(五)犯罪嫌疑人、被告人死亡的;(六)其他法律规定免予追究刑事责任的。
