离婚协议是否一定要公证
释义
离婚协议要不要公证按个人意愿。离婚协议公证只是证明双方签定协议的行为真实合法。离婚协议的公证不是离婚协议书生效的必要条件，也不能证明婚姻关系的解除。离婚协议书只要合法、是双方的真实意思表示，经登记机关备案后生效，对双方产生法律约束力。

夫妻双方自愿离婚的，应当签订书面离婚协议，并亲自到婚姻登记机关申请离婚登记。离婚协议应当载明双方自愿离婚的意思表示和对子女抚养、财产以及债务处理等事项协商一致的意见。
