释义	法律分析：同居关系中，一方死亡，另一方不能通过法定继承继承其遗产。没有《民法典》的规定办理结婚登记，而以夫妻名义共同生活的男女，一方在同居期间死亡的，另一方是不能以配偶身份主张自己享有继承权的，因此也不可能通过法定继承方式继承遗产。但是如果被继承人生前立有遗赠的，可以按照遗赠处理，由同居的一方继承其遗产。法律依据：《民法典》第一千一百二十三条，继承开始后，按照法定继承办理；有遗嘱的，按照遗嘱继承或者遗赠办理；有遗赠扶养协议的，按照协议办理。
