释义	根据《工伤保险条例》第十九条第二款规定：“职工或者其直系亲属认为是工伤，用人单位不认为是工伤的，由用人单位承担举证责任”1、原则上，适用“谁主张，谁举证”。否则，承担举证不能的不利后果。2、职工或者其直系亲属认为是工伤，用人单位不认为是工伤的情况下，由该用人单位承担举证责任。用人单位拒不举证的，社会保险行政部门可以根据受伤害职工提供的证据依法作出工伤认定结论。
