问题	合同没有审批手续合同有效吗
释义	法律分析：发包人就尚未取得建设用地规划许可证、建设工程规划许可证等行政审批手续的工程，与承包人签订的建设工程施工合同无效。但在一审法庭辩论终结前发包人取得相应审批手续或者经主管部门批准建设的，应当认定合同有效。发包人未取得建筑工程施工许可证的，不影响施工合同的效力。法律依据：《建筑工程质量管理条例》第五条规定，从事建设工程活动，必须严格执行基本建设程序，坚持先勘察、后设计、再施工的原则。县级以上人民政府及其有关部门不得超越权限审批建设项目或者擅自简化基本建设程序。
