问题	哪些因素会影响房屋买卖中商品房预售合同效力
释义	根据我国相关法律规定，商品房预售合同属于应办理登记备案的合同，但该登记备案是否为合同的生效要件，目前存在着争议。如果预售合同以登记备案为生效要件，则预售合同自登记备案之日起成立;如果不以登记备案为合同的生效要件，则合同自签订之日起成立。对此的认识，涉及到预购方对开发商和预购商品房的权益保护问题。笔者认为，预售合同登记备案不应是预售合同的生效要件，预购方的权益在预售合同依法签订时即已成立。法律依据《房屋买卖合同司法解释》第八条
