释义	遗嘱只要是自己真实意思表示都是有效的。但是涉及到处置夫妻共同财产只是部分无效。遗嘱必须是具备遗嘱能力之人所为，符合法定要式者，才是一个在法律上有效的遗嘱。得为遗嘱的能力称为遗嘱能力。在香港，遗嘱的订立需要有至少两位非受益人担任见证人，遗嘱才具有法律效力。一般而言，这两位见证人的其中一位会由协助订立遗嘱的律师楼合伙人担任，而另一人则由前述律师所邀请的同业(一般由邻近律师楼的合伙人，但不能采用同一律师楼的其他合伙人)担任。
