释义	法律分析：我国年满17岁不算童工，童工是指年龄未满16周岁，与单位或者组织形成劳动关系从事有经济收入的劳动或者从事个体劳动的少年、儿童。凡用人单位使用童工的，由劳动保障行政部门按照每使用一名童工每月处5000元罚款的标准给予处罚。法律依据：《禁止使用童工规定》第七条单位或者个人为不满16周岁的未成年人介绍就业的，由劳动保障行政部门按照每介绍一人处5000元罚款的标准给予处罚。
