释义	暴力取证罪是指司法工作人员以暴力逼取证人证言、被害人陈述的行为。涉嫌下列情形之一的，应予立案：1、手段残忍、影响恶劣的;2、致人自杀或者精神失常的;3、造成冤、假、错案的;4、3次以上或者对3人以上进行暴力取证的;5、授意、指使、强迫他人暴力取证的。法律依据《人民检察院直接受理立案侦查案件立案标准的规定（试行）三、（四）
