释义	不当得利与侵权的区别： 1、不当得利指没有合法根据，或事后丧失了合法根据而被确认为是因致他人遭受损失而获得的利益。不当得利属于民事行为，需要承担民事责任； 2、侵权行为是一种侵害他人权益的行为，因此侵权行为也可以称为一种侵害行为。法律依据：《中华人民共和国民法典》第九百八十五条得利人没有法律根据取得不当利益的，受损失的人可以请求得利人返还取得的利益，但是有下列情形之一的除外：（一）为履行道德义务进行的给付；（二）债务到期之前的清偿；（三）明知无给付义务而进行的债务清偿。
