释义	法律分析：单位受贿罪，是国家机关、国有公司、企业、事业单位、人民团体，索取、非法收受他人财物，为他人谋取利益，情节严重，或者在经济往来中，在帐外暗中收受各种名义的回手续费的行为。单位受贿罪的主体是单位，而且只能是国家机关、国有公司、企业、事业单位、人民团体等国有单位。法律依据：《中华人民共和国刑法》第三百八十五条受贿罪，法人受贿罪除犯罪主体不同外，在犯罪客观方面也有实质区别。受贿罪以“利用职务上的便利”为其客观方面的要件之一，但法人受贿罪则不以此为限。
