释义	没有逮捕不代表不需要负刑事责任。如果案件事实清楚、证据充分的话，公安还是会把案件移送检察院审查起诉，检察院如果审查认为构成犯罪的话还是会向法院提起公诉，法院最后判刑。【法律依据】《刑事诉讼法》第九十二条：不批捕的异议，公安机关对人民检察院不批准逮捕的决定，认为有错误的时候，可以要求复议，但是必须将被拘留的人立即释放。如果意见不被接受，可以向上一级人民检察院提请复核。上级人民检察院应当立即复核，作出是否变更的决定，通知下级人民检察院和公安机关执行。
