释义	劳动争议仲裁的举证责任一般是谁主张谁举证的原则，但在劳动纠纷中，劳动者处于弱势地位，因此劳动者无法提供由用人单位掌握管理的与仲裁请求有关的证据，仲裁庭可以要求用人单位在指定期限内提供。法律依据《中华人民共和国劳动争议调解仲裁法》第三十九条当事人提供的证据经查证属实的，仲裁庭应当将其作为认定事实的根据。劳动者无法提供由用人单位掌握管理的与仲裁请求有关的证据，仲裁庭可以要求用人单位在指定期限内提供。用人单位在指定期限内不提供的，应当承担不利后果。
