老人去世后宅基地应该怎样处理
释义
老人去世后宅基地由集体讨论分配，宅基地使用权按照继承人的实际情况决定。如果继承人是本村集体组织的成员，并且符合申请宅基地的条件，那就可以继承。如果继承人不是本村集体组织成员，或不符合申请宅基地的条件，就不可以继承。
法律依据
《中华人民共和国土地管理法》第六条，城市市区的土地属于全民所有即国家所有。
农村和城市郊区的土地，除法律规定属于国家所有的以外，属于集体所有；宅基地和自留地、自留山，属于集体所有。
