法律依据：
《中华人民共和国劳动法》第九十四条 用人单位非法招用未满十六周岁的未成年人的，由劳动行政部门责令改正，处以罚款节严重的，由工商行政管理部门吊销营业执照。情节严重的，则依照〈中华人民共和国刑法〉定罪处罚。
