释义	当事人办理离婚公证，应到其住所地的有管辖权的公证处提出申请。离婚协议是夫妻双方为了解除婚姻关系的财产物品处理而引起的双方法律行为。离婚协议公证是公证机关依法证明夫妻双方为解除婚姻关系就子女抚养、财产处理等事项签订协议行为的真实性，合法性的活动。离婚协议公证不是证明其婚姻关系的解除，仅是证明双方为解除婚姻关系，就子女抚养、住房使用、财产分割问题签订协议行为的真实性、合法性。而婚姻关系的解除必须到婚姻登记机关申请登记并自领取《离婚证》的前后进行，公证时应携带双方身份证和结婚证书或离婚证书。
