释义	【法律意见】劳动合同终止的补偿、赔偿要分以下情况处理：1、劳动合同到期，用人单位提高或者维持原待遇要求续订劳动合同，而劳动者不同意的，不需要支付经济补偿。不符合前述条件的，要向劳动者支付经济补偿金。2、劳动合同期内，劳动者有严重违反规章制度等情形的，用人单位可依法解除劳动合同，并不需要支付经济补偿金。3、劳动合同期内，用人单位没有劳动合同法的根据，而违法与劳动者解除劳动合同的，要双倍支付经济补偿金。
