释义	法律分析：缓刑是一种刑罚制度,不是有期徒刑以上刑罚。缓刑,也称为暂缓执行刑罚。是刑法上的一种刑罚制度。法院在刑事审判中,根据被判处刑罚的罪犯的犯罪情节和悔罪表现,规定一定的考验期,暂缓刑罚的执行。法律依据：《中华人民共和国刑法》第七十三条拘役的缓刑考验期限为原判刑期以上一年以下，但是不能少于二个月。有期徒刑的缓刑考验期限为原判刑期以上五年以下，但是不能少于一年。缓刑考验期限，从判决确定之日起计算。第七十四条对于累犯和犯罪集团的首要分子，不适用缓刑。
