释义	无效婚姻应当退还彩礼。如果婚姻无效，也就是两人没有经过合法的婚姻登记，则根据法律规定，女方应当返还彩礼。无效婚姻或可撤销婚姻在被撤销后，双方当事人同居期间各自取得的财产归个人所有，对是否为个人财产，举证不明且无法查实的，按共同财产认定，均有分割权。法律依据：《婚姻法》第十二条：无效或被撤销的婚姻，自始无效。当事人不具有夫妻的权利和义务。同居期间所得的财产，由当事人协议处理；协议不成时，由人民法院根据照顾无过错方的原则判决。
