释义	法律分析: 订立劳动合同可以保护劳动者权利，以及明确劳动者和用人单位的义务。其因为订立劳动合同实书面形式，在出现劳动纠纷时，法院或者仲裁机构能够相对容易地确认用人单位和劳动者之间的权利义务。这样对保护劳动者的利益也能够做到比较客观和公正。法律依据: 《劳动合同法》第十条建立劳动关系，应当订立书面劳动合同。已建立劳动关系，未同时订立书面劳动合同的，应当自用工之日起一个月内订立书面劳动合同。用人单位与劳动者在用工前订立劳动合同的，劳动关系自用工之日起建立。
