分手后能要分手费吗

法律分析：分手后不可以索要分手费。一方当事人以给付分手费作为结束双方关系的条件，违背了平等与意思自治原则，即便是在其没有任何胁迫意思表示的情形下，另外一方当事人意志自由难免处于强制状态，意志自由的被强制必然导致了双方地位的不平等，其意思表示的真实性也自然受到了质疑，那么是不受法律保护的。
法律依据：《中华人民共和国民法典》 第五条 民事主体从事民事活动，应当遵循自愿原则，按照自己的意思设立、变更、终止民事法律关系。
