小区车棚被物业出租合理吗 |
| 释义 |
不合理，侵犯全体业主的权益。小区内绿化地带等公共区域属于全体业主所有，物业不能擅自盖成车库和搭建自行车棚。如果物业搭盖的车棚是经业委会或业主大会审议通过的，就不算违建。另外，停车棚属于功能性设施，算不上建筑。物业管理区域内按照规划建设的公共建筑和共用设施，不得改变用途。业主依法确需改变公共建筑和共用设施用途的，应当在依法办理有关手续后告知物业服务企业；物业服务企业确需改变公共建筑和共用设施用途的，应当提请业主大会讨论决定同意后，由业主依法办理有关手续。

第一百二十条 民事权益受到侵害的，被侵权人有权请求侵权人承担侵权责任。
第一百八十三条 因保护他人民事权益使自己受到损害的，由侵权人承担民事责任，受益人可以给予适当补偿。没有侵权人、侵权人逃逸或者无力承担民事责任，受害人请求补偿的，受益人应当给予适当补偿。
第一千一百六十七条 侵权行为危及他人人身、财产安全的，被侵权人有权请求侵权人承担停止侵害、排除妨碍、消除危险等侵权责任。
第一千一百六十八条 二人以上共同实施侵权行为，造成他人损害的，应当承担连带责任。
