释义	多数情况下应由发生人身损害的饮酒人自负损失。但如果饮酒出事，有四种情需承担法律责任：1、强迫性劝酒，2、明知对方不能喝酒仍劝其饮酒，3、未将醉酒者安全护送，4、酒后驾车未劝阻导致发生车祸等损害的。法律依据: 《中华人民共和国民法典》第一千一百六十五条行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。依照法律规定推定行为人有过错，其不能证明自己没有过错的，应当承担侵权责任。
