《中华人民共和国旅游法》
第六十三条
旅行社招徕旅游者组团旅游，因未达到约定人数不能出团的，组团社可以解除合同。但是，境内旅游应当至少提前七日通知旅游者，出境旅游应当至少提前三十日通知旅游者。
因未达到约定人数不能出团的，组团社经征得旅游者书面同意，可以委托其他旅行社履行合同。组团社对旅游者承担责任，受委托的旅行社对组团社承担责任。旅游者不同意的，可以解除合同。
因未达到约定的成团人数解除合同的，组团社应当向旅游者退还已收取的全部费用。
