释义	法律分析：民事行为如果意思表示有缺陷，不符合民事法律行为的生效要件的，按理都是无效的，但民法基于意思自治原则，对于只涉及当事人而不谁国家或第三人利益的意思有缺陷的民事行为，其有效还是无效的选择权被赋予行为人自己，既赋予当事人撤销权或变更权。类型有：重大误解、显失公平、趁人之危、欺诈胁迫。法律依据：《中华人民共和国民法典》第六百一十八条当事人约定减轻或者免除出卖人对标的物瑕疵承担的责任，因出卖人故意或者重大过失不告知买受人标的物瑕疵的，出卖人无权主张减轻或者免除责任。
